1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für die Nutzung der App „ROVE Running“ (nachfolgend „App“) sowie für den Abschluss kostenpflichtiger Abonnements und Einmalkäufe innerhalb der App. Anbieter der App ist:

2. Leistungsbeschreibung

Die App ist ein Lauf- und Fitness-Tracking-Tool, das GPS-Aktivitäten aufzeichnet, Trainingspläne und Ziele verwaltet und optional mit Apple Health/Health Connect sowie einem Bluetooth-Pulsmesser zusammenarbeitet. Ein Grundfunktionsumfang ist kostenlos nutzbar („Gratis-Version“). Gegen Entgelt steht zusätzlich „ROVE Pro“ zur Verfügung, das erweiterte Funktionen freischaltet (u. a. Ziele, Trainingspläne, Challenges, Routengenerierung und Bluetooth-Pulsmesser). Der genaue Funktionsumfang beider Stufen ist in der App auf der Paywall-Seite einsehbar.

3. Vertragsschluss

Ein Vertrag über ein ROVE-Pro-Abonnement kommt ausschließlich über den jeweiligen App Store (Apple App Store bzw. Google Play Store) zustande, nicht direkt mit dem Anbieter. Zahlungsabwicklung, Rechnungsstellung und Kundenkonto liegen beim jeweiligen App-Store-Betreiber; es gelten zusätzlich dessen eigene Nutzungsbedingungen.

4. Preise, Laufzeit und Kündigung

Die aktuellen Preise sind auf der Paywall-Seite in der App einsehbar. Abonnements (monatlich, alle 3 Monate, jährlich) verlängern sich automatisch zum jeweils gültigen Preis um denselben Zeitraum, sofern sie nicht mindestens 24 Stunden vor Ende des aktuellen Abrechnungszeitraums gekündigt werden (bei Google Play ist eine Kündigung bis kurz vor der Verlängerung möglich). Die Kündigung erfolgt ausschließlich über die Kontoeinstellungen des jeweiligen App Stores (Apple-Account bzw. Google Play unter „Zahlungen und Abos“), nicht in der App selbst. Neue Abonnent:innen können ROVE Pro zunächst 7 Tage kostenlos testen, mit einem gültigen Empfehlungscode 30 Tage. Der kostenlose Testzeitraum steht pro Konto nur einmal zur Verfügung. Wird das Abo nicht rechtzeitig vor Ende des Testzeitraums gekündigt, beginnt danach das kostenpflichtige Abo.

Über Aktionscodes des App Stores (z. B. Angebotscodes von Apple) kann ROVE Pro für einen festgelegten Zeitraum kostenlos freigeschaltet werden. Es gelten die beim jeweiligen Code angegebenen Bedingungen.

5. Widerrufsrecht

Verbraucher:innen steht grundsätzlich ein 14-tägiges Widerrufsrecht nach den gesetzlichen Vorschriften zu. Das Widerrufsrecht erlischt vorzeitig, wenn mit der Ausführung des Vertrags (z. B. Freischaltung der Pro-Funktionen) begonnen wurde, nachdem ausdrücklich zugestimmt wurde, dass die Leistung vor Ablauf der Widerrufsfrist beginnt, und gleichzeitig bestätigt wurde, dass dadurch das Widerrufsrecht erlischt. Diese Bestätigung erfolgt im Kaufvorgang des jeweiligen App Stores. Unabhängig davon können Abonnements wie unter Punkt 4 beschrieben jederzeit zum Ende der laufenden Periode gekündigt werden.

6. Nutzungsrechte und Haftung

Die in der App dargestellten Werte (u. a. Kalorienverbrauch, Trainingspläne, Herzfrequenzdaten) dienen ausschließlich der persönlichen Trainingsübersicht und stellen keine medizinische Beratung dar. Bei gesundheitlichen Beschwerden oder vor Beginn eines neuen Trainingsprogramms sollte ärztlicher Rat eingeholt werden. Der Anbieter haftet nicht für Schäden, die aus der Nutzung der App oder der Verwendung der darin angezeigten Werte entstehen, soweit gesetzlich zulässig – ausgenommen bei Vorsatz oder grober Fahrlässigkeit sowie bei der Verletzung von Leben, Körper oder Gesundheit.

7. Nutzerkonto und Verhaltensregeln

Für die Freunde-Funktionen, Ranglisten und Challenges kannst du ein Nutzerkonto anlegen. Dein Anzeigename und dein Profilbild sind dort für andere Nutzer sichtbar. Anstößige, beleidigende, diskriminierende, sexuelle oder rechtswidrige Inhalte sowie die Belästigung anderer Nutzer sind nicht erlaubt; hierfür gilt null Toleranz. Unzulässige Anzeigenamen werden automatisch ersetzt. Du kannst andere Nutzer in der App melden und blockieren. Wir prüfen jede Meldung innerhalb von 24 Stunden und entfernen unzulässige Inhalte; Konten, die gegen diese Regeln verstoßen, können gesperrt oder gelöscht werden.

8. Änderungen dieser AGB

Der Anbieter behält sich vor, diese AGB zu ändern, etwa bei Änderungen des Funktionsumfangs oder der Preisgestaltung. Über wesentliche Änderungen wird in geeigneter Form informiert.

9. Schlussbestimmungen

Es gilt das Recht der Bundesrepublik Deutschland. Sollte eine Bestimmung dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen davon unberührt.

2. Description of the service

The App is a running and fitness tracking tool that records GPS activities, manages training plans and goals, and can optionally work with Apple Health/Health Connect and a Bluetooth heart rate monitor. A basic set of features can be used free of charge (“free version”). For a fee, “ROVE Pro” is also available, which unlocks additional features (including goals, training plans, challenges, route generation and Bluetooth heart rate monitors). The exact features of both tiers can be viewed in the App on the paywall page.

3. Conclusion of contract

A contract for a ROVE Pro subscription is concluded exclusively via the respective app store (Apple App Store or Google Play Store), not directly with the provider. Payment processing, invoicing and the customer account are handled by the respective app store operator; its own terms of use also apply.

4. Prices, term and cancellation

Current prices can be viewed on the paywall page in the App. Subscriptions (monthly, every 3 months, yearly) renew automatically for the same period at the price applicable at that time unless they are cancelled at least 24 hours before the end of the current billing period (on Google Play, cancellation is possible until shortly before renewal). Cancellation is only possible in the account settings of the respective app store (Apple Account or Google Play under “Payments & subscriptions”), not in the App itself. New subscribers can try ROVE Pro free of charge for 7 days at first, or for 30 days with a valid referral code. The free trial is available only once per account. If the subscription is not cancelled in time before the end of the trial, the paid subscription begins afterwards.

ROVE Pro can be unlocked free of charge for a set period via promotional codes from the app store (e.g. Apple offer codes). The conditions stated for the respective code apply.

5. Right of withdrawal

Consumers generally have a 14-day right of withdrawal under the statutory provisions. The right of withdrawal expires early if performance of the contract (e.g. unlocking the Pro features) has begun after you have expressly agreed that the service may begin before the end of the withdrawal period and have at the same time confirmed that you thereby lose your right of withdrawal. This confirmation is given during the purchase process of the respective app store. Regardless of this, subscriptions can be cancelled at any time with effect from the end of the current period as described in section 4.

6. Rights of use and liability

The values shown in the App (including calories burned, training plans and heart rate data) are intended solely as a personal overview of your training and do not constitute medical advice. If you have health complaints or before starting a new training programme, you should seek medical advice. To the extent permitted by law, the provider is not liable for damage arising from the use of the App or of the values shown in it, except in cases of intent or gross negligence and in cases of injury to life, body or health.

7. User account and rules of conduct

You can create a user account for the friends features, leaderboards and challenges. Your display name and profile picture are visible to other users there. Offensive, insulting, discriminatory, sexual or unlawful content and the harassment of other users are not allowed; zero tolerance applies. Inadmissible display names are replaced automatically. You can report and block other users in the App. We review every report within 24 hours and remove inadmissible content; accounts that violate these rules may be suspended or deleted.

8. Changes to these Terms

The provider reserves the right to change these Terms, for example if the features or pricing change. You will be informed of material changes in an appropriate way.

9. Final provisions

The law of the Federal Republic of Germany applies. Should any provision of these Terms be invalid, the validity of the remaining provisions shall not be affected.
